During the 2024 legislative session, the regulation of electric vehicle (EV) charging stations was preempted to the state in Section 366.94, Florida Statutes (F.S.).
Following the statutory changes, Rule 5J-28, Florida Administrative Code, was adopted to further clarify the registration requirements and to establish uniform standards that will provide guidance to entities that regulate, operate and construct EV charging stations. These rules detail aspects of safety, design, required signage, permitting, zoning, registration and enforcement of prohibited uses of EV charging stations.
Pursuant to these regulations, owners or operators of EV charging stations that are available for public use are required to register annually. The requirements of the rule apply regardless of whether there is a fee or cost associated with the use of the charger.

Sections 531.60–531.66, F.S., require users of weighing and measuring devices to have a permit issued by the Florida Department of Agriculture and Consumer Services (FDACS) prior to using the devices in commerce. Each EV charging device that requires a fee for use by the public must also have a valid Weighing and Measuring (WAM) device permit.
FDACS will inspect all registered devices for safety and perform calibration tests on all devices that require a WAM permit.
