Water lettuce (Pistia stratiotes), hygro (Hygrophila polysperma) and ambulia (Limnophila sessiliflora) are listed as Class II prohibited aquatic plants in Rule 5B-64, Florida Administrative Code (F.A.C.). These species are considered to be highly invasive and noxious in localized areas of the state of Florida.

Who Needs a Permit?

As stated in Section 581.145, Florida Statutes and Rule 5B-64, F.A.C., individuals or entities engaging in the transportation, cultivation, collection, or possession of plant species listed as Class II prohibited aquatic plants must obtain a permit. These plants may be cultured as nursery stock intended for export (shipping out of state) only. When produced as nursery stock, individuals or entities must be a registered plant nursery with the Florida Department of Agriculture and Consumer Services (FDACS).   Selling and distributing Class II prohibited aquatic plants in the state of Florida is prohibited.

How to Obtain a Permit

  1. Complete an FDACS-08208 Application and Permit to Move Organisms Regulated by the State of Florida [ Adobe PDF Document ] listing the plant species to be exported out of state.
  2. Email a signed application to DPI-Permits@FDACS.gov or mail a paper copy of the form to: Division of Plant Industry — Permit Section, P.O. Box 147100, Gainesville, FL 32614-7100.

Please note: Hygro (H. polysperma) and ambulia (L. sessiliflora) are both included on the Federal Noxious Weed List and additional federal permits for interstate movement may be required.
